David L. Minchello is a member of the firm’s Litigation Department and the Public Entity and Government Law Department. His practice areas include governmental entity, insurance defense, municipal law, small business matters, and personal representation, including wills, power of attorney, and advance care directives.
Mr. Minchello’s representative clients include Fortune 50 corporations, municipalities, small and mid-size businesses, and professional associations. In his governmental entity practice, he has defended municipalities against discrimination and whistleblower claims; represented municipalities in disciplinary hearings and appeals; defended police officers against wrongful arrest/excessive force claims; and advised municipalities on employment matters prior to litigation. He has also defended municipalities against Title 59 claims, recovered bail money forfeited by surety companies for the municipality, and advised municipalities on the legality of proposed ordinances based on relevant statutes and most recent case law.
Mr. Minchello represents corporations in defense of auto negligence and premises liability matters. He routinely handles incorporations, drafting of bylaws, review of partnership agreements, and contract reviews for small businesses. He is the author of “New Jersey Paid Leave Act: Small Businesses Most at Risk” in Somerset Business Magazine, December 2007.
He represents individuals in personal matters including the drafting of wills, power of attorney, and advance care directives. Mr. Minchello also defends individuals charged in municipal court with traffic violations, DWI, and simple assault.
Mr. Minchello is a volunteer Mediator for the Superior Court of New Jersey, Somerset County, Special Civil Part. His community activity includes his work representing plaintiffs in special education matters as a volunteer attorney for the Essex County Lawyers for Justice. He is the founder of the Friends of Brookside Park, a community association dedicated to the preservation of open space, and a past member of the Board of Directors of the Tri-County Red Cross.
Mr. Minchello holds a B.A. from Vassar College and a J.D. from Seton Hall University School of Law. He is admitted to practice in New Jersey and the U.S. District Court, District of New Jersey. He is a member of the New Jersey Institute of Local Government Attorneys.
